Texas rules for real estate documents

• Notarizing for someone who did not personally appear is a state jail felony when the document transfers real property (§406.0091).
• The notary must record the grantee and, for land, the county where it is located, in their notary book (§406.014).
• Your lender or title company usually chooses the notary or signing agent; ask before booking one yourself.

Before you book

• Every signer needs an unexpired government-issued photo ID (what ID to bring).
• Do not sign until you are in front of the notary.
• Texas caps the notarial fee itself ($10 first signature on an acknowledgment, $1 each additional; §406.024). Ask for the total, including any travel charge, before you book. See notary fees in Texas.
